Impaired driving continues to be the most deadliest crime nation wide. The President has named December as national drunk and drugged driving prevention month to raise awareness about the hazards of driving under the influence.

According to CDC statistics, every day, 36 people in the Nation die, and approximately 700 additional people are injured, in motor vehicle crashes that involve an alcohol-impaired driver.

According to the National Highway Traffic Safety Administration (NHTSA), about three in every ten Americans will be involved in an alcohol-related crash at some point in their lives.

In 2006, 13,470 people died in alcohol-impaired driving crashes, accounting for nearly one-third (32%) of all traffic-related deaths in the United States.
In one year, over 1.4 million drivers were arrested for driving under the influence of alcohol or drugs.

Blind Zones Result in Injuries

The Department of Transportation recommended new guidelines that will assist in eliminating vehicle blind zones that can obscure the existence of pedestrians, particularly children. These proposed guidelines would affect vehicles weighing 10,000 pounds or less.
On average there are an estimated 292 deaths annually and 18,000 injuries every year due to backing vehicles. The new requirements for light vehicles, could save 292 lives per year.

A rear blind zone is defined as the area immediately behind your back bumper. This is the area that you are unable to see what is there. This becomes hazardous when you back into unseen pedestrians or elderly. As a result, NHTSA is creating regulations that mandate better rear field-of-view for new vehicles.

NHTSA foresees that the vast majority of car companies will comply with the new standards by placing rear-view cameras in each light weight vehicle. Cameras expose anything that is immediately behind a reversing vehicle.

Arkansas recenty received a score of 8 out of a possible 14 points, according to The Emergency Nurses Association's national score card. Arkansas' improvements were credited to a stricter graduated driver's license for adolescents, enacting law that made seat belt use mandatory, and enacting laws that made texting while driving illegal.

The Emergency Nurses Association's score card highlights laws that can be beneficial in preventing deaths and injuries caused from motorvehicle accidents on the highways. According to the National Highway and Traffic Safety Administration, approximately 37,000 fatalities occur every year on our nation's highways.

Oregon and Washington were the only states to receive a perfect score of 14.

Injury- Teen Drivers and Pickups

A recent study shows Teens and pickups doubles the increase for injury. The research included data from approximately 7,000 collisions nationwide from 2005 to 2007.

The study revealed teenagers driving pickups are twice as likely to experience severe injuries in a collision as those driving other types of vehicles, including sport utility vehicles.

The reason for this finding:
"For one, the study found – and this will surprise no one – that teen drivers, in general, are more accident-prone and inclined to drive aggressively. Also, auto and insurance experts say, pickups typically increase aggressive driving behaviors.

Put the two factors together, and you've got trouble.

On top of that, pickups generally don't fare as well as other vehicles in crash tests, have a high rollover frequency and are more difficult to control and correct, translating into more severe injuries when accidents do happen." Dallas Morning News, November 21, 2010.

According to the author of the study, parents should think twice before placing their teens in pickups. "The sensation-seeking, risk-seeking, adventure-seeking behaviors enhance when pickups are in the hands of teenagers, which leads to more aggressive driving," he said.

On or about January 1, 2011 instead of driving an injured person to the nearest hospital, they will be taken to the hospital that is best equipped to treat their injuries. The new system will determine where an injured person should be taken based on their injuries. The goal is to reduce injury related deaths.

This new trauma system will network hospitals and other emergency service providers statewide. The focus is to transport the injured person to the facility that is best able to treat their injuries. The 911 system will still be used. A medical technician will then evaluate the severity of the injuries and notify central command of their assesssment to determine where to transport the injured person. If the person requires stabilization first, they will be transported to the nearest facility to stabilize and then transport to another facility if necessary. It is anticipated this will reduce deaths related to injuries by approximately 25%.

18 Wheeler Fatality Highway Accident

On Friday, September 24th, 2010 an 18 wheeler attempted to pass a vehicle when it hit an oncoming 2010 Ford Edge driven by David Beasley, 37 of Little Rock and then hit an eastbound 2011 Toyota Camry driven by Rebecca Baltz of Little Rock, Arkansas. The semi truck was driven by John Rader of Avery, Texas.
David Beasely died in this 18 wheeler collision, while Rebecca Baltz and her passenger Jonnie Oden of Little Rock were taken to UAMS. The driver of the semi truck, John Rader was not injured.
Location: Near intersection of Arkansas 88 in Saline County, Arkansas.

Traffic Fatalities Record Low

According to the U.S. Department of Transportation statistics, 2009 traffic fatalities reached its lowest level since 1954. For 2009 total fatalities were approximately 33,963, representing a 9 percent decline from 2008's fatalities of 37,261.

The National Highway Traffic Safety Administration (NHTSA) attributes the reduction in deaths to the success of its "Click It or Ticket," and "Over the Limit. Under arrest" law-enforcement campaigns. Other contributing factors are additional safety features incorporated into automobile designs. NHTSA continues to focus on "distracted driving" campaign in an effort to reduce fatalities as well.

ElDorado Woman Killed in Crash

Facts: On February 6, 2010, Joshua Wiltgen of Marion, lost control of his Saturn, crossing the center line and stricking the driver's side of Nathaniel Smith's vehicle. Wiltgen died at the scene. Nathaniel Smith of Wynne was taken to Crossridge Community Hospital in Wynne.

Statitistics: According to a 2007 study by the Arkansas State Police there were a total of 1,624 crashes resulting from being sidesiped from a vehicle travelling in the opposite direction. Of this total, 17 resulted in fatalities.

According to police reports, on January 18, 2010 Thadeus McBride of Mountain Home ran off the road on Highway 5 in Baxter County. Upon re-entry, James Dykhouse 68 of Mountain Home was hit head on. James Dykhouse died at the scene.
Head On collisions resulted in 107 fatalities in Arkansas according to a 2007 Arkansas State Police report. There were a total of 1,176 head on collisions according to this same report.

Few consumers think about the age of their tires. When in reality, it is made of rubber and begins to degrade over time despite the fact that it may still look brand new. It is this degradation process that can make your tires unsafe to drive on. They do not have an expiration date resulting in a hidden danger.

Many tires that are sold have been sitting in inventory for long periods of time. Over time this rubber begins to break down and lose its elasticity. It is this aging process that causes it to become unstable and therefore unsafe to drive on. They could literally come apart or explode while driving causing serious injury or death.

It is important to check the age of your tires. Few people realize the danger of driving on dated tires. The birth date of your tire is imprinted on the wall of the tire. It is is usually the last digits in a series of DOT numbers. The first two digits represent the week it was manufactured, while the last one or two digits represent the year it was manufactured. If the tire was manufactured before 2000, there are only 3 digits to signify the week and the year of manufacture. For example if the last three digits are 349, then then it was manufactured in the 34th week of 1999. If this number is not visible on the outside of your tire, look at the interior wall underneath your vehicle. Obviously this information is not meant to be consumer friendly.

Rubber starts to deteriorate shortly after it is manufactured. Research has shown that you should replace your tires if they are six years of age or older. After 6 years of age they can become increasingly dangerous by coming apart or exploding. Do not trust the tread on the tire. Look on the tire to verify the year of manufacture. Replace them every 6 years.

Tires have a shelf life and ignoring this could end your life.

Arkansas Governor Beebe signed the trauma system into law March 13, 2009. This will establish a statewide system of emergency care to ensure people injured in serious car wrecks or other serious traumas are able to get the emergency medical care needed as quickly as possible.
It will create a communications network to help emergency responders transport patients directly from the accident scene to the hospital best able to treat their injuries.

Events: A Gravel Ridge man was killed Sunday afternoon in a Car Crash. The State Police report indicated Adam Albright passed a tow truck and spun sideways into the path of William Hill and Christy Lane of Jacksonville. Hill and Lane were transported to North Metro Medical Center. Albright died in the crash.

According to State Police Batesville woman, Marjorie Ferguson died Saturday when another car crossed over Arkansas 106 and collided with her vehicle. Keith Cowden was transferred to White River Medical Center Hospital.

Two Vehicle Accident, One Fatality, Two Injured

Location: Bentonville at Arkansas Highway 12 and Regional Boulevard.

Facts: Driver of the Ford F-150 truck was northbound on Regional Boulevard and failed to stop at the stop sign located at the intersection of Regional Boulevard and Arkansas 12. Steven Homewood, the driver of the Ford F-150 collided with a Chevy Blazer that was traveling east on Arkansas 12. The driver of the Ford F-150 died at the scene. The two occupants, George Black and Karen Heath, of the Chevy Blazer were transported to Northwest Medical Center in Bentonville.

Ohio Man Killed In Johnson County Crash

Sunday, February 15, 2009, David Stanley of Ohio was traveling west on Interstate 40 when he crossed over the center line striking Harish Chandler Singh of California. Stanly was pronounced dead at the scene. Singh was taken to Johnson Regional Medical Center.

Fouke Superintendent Killed in Lonoke County Car Crash

Paulette Smith, the superintendent of Fouke School District was killed January 21, 2009 when her car was hit by a truck that spun around after being hit by another vehicle at the intersection of Highway 5 and Highway 89 (in Lonoke County). The car that hit the pick up truck failed to stop at a red light. Jody Sipes, of Jacksonville, driver of the pick up truck was hurt in the accident. No details were available regarding her condition.

NUDE MOTORCYCLIST REAR ENDED

Just when I thought I had heard it all. . . One person writes "It gives a whole new meaning to the expression "rear ended." I have to agree. According to the Daily Citizen a naked man was riding his motorcycle in downtown Searcy on January 26, 2009 As he was being pursued by police through downtown Searcy he was rear ended by one of the squad cars. When they finally apprehended the naked rider he was transported to the hospital.

AT-FAULT DRIVER'S INSURANCE COMPANY WON'T PAY FOR MY MEDICAL BILLS

An injured car wreck victim recently called me to complain that the AT FAULT DRIVER's insurance company would not pay for his medical care related to the incident. In fact they told him to pay for this care up front and he would be reimbursed later. He did not think this was fair. But the reality is, the AT FAULT DRIVER'S insurance company does not pay for your medical care during your treatment period. You are compensated for the out of pocket expenses at the time of settlement, which is usually at the end of your treatment period. That is why it is a good idea to have a Personal Injury Protection Policy as part of your automobile insurance coverage. Normally the minimum Personal Injury Protection ("PIP") coverage is $5,000.00. However, if the injuries are significant this minimum amount is used up quickly and usually once your health care insurance finds out that these injuries were due to a car wreck, they frequently will not pay for that care. According to a recent Arkansas news article an increased number of hit and run accidents are being reported. Leaving the scene of the accident is likely due to not having insurance or the driver was under the influence or there were outstanding warrants for the driver.
An uninsured driver is someone who does not have insurance. A hit and run driver counts as an uninsured driver.
An underinsured driver is someone who carried the legal minimum as required by the state, but it is not enough to pay for the damages caused to you or your property.

Coverage: Uninsured insurance coverage will provide coverage if you are hit by an uninsured or a hit-and-run driver.
Underinsured insurance coverage comes into play when an at-fault driver doesn't have enough insurance coverage to pay for the damage he caused to the other driver's property or person.

The best way to protect yourself is to increase your uninsured and underinsured limits on your automobile policy. AN INJURED CAR ACCIDENT VICTIM CALLED ME LAST WEEK WITH THE FOLLOWING SCENARIO: "I was rear ended and it was not my fault.". . "A Company with "INURY" as part of their business title called me and told me that I did not need an attorney for my car wreck case. They said involving an attorney would only cost me part of my settlement. Instead they were kind enough to refer me to a specific business where I could receive therapy for my back and neck."
They were so nice to have called her and given her a referral to a specific place of treatment.. . . NOT! Upon arrival and subsequent multiple visits to this specific provider, my client noticed that other car wreck victims were being brought in, physically accompanied by the "empoloyees" of the business with "INJURY" in their business title.
Morale of the story: If you have been injured through the negligence of someone else and someone, whom you do not know, calls you or turns up at your door step and tells you to use a specific health care provider or even an attorney for that matter, you should know YOU HAVE THE RIGHT TO MAKE YOUR OWN CHOICE. We as attorneys are prohibited from making these types of solicitations.
